LME Account Terms and Conditions

These terms and conditions (T&Cs) set out the ways in which you are permitted to use your online London Marathon Events account (LME Account).

Please read these T&Cs before registering for and using your LME Account (including via any LMG Sites, as defined in our Terms of Use). The LMG Sites and the LME Account are owned and operated by London Marathon Events Limited ("LMEL", "we", "us" or "our").

We reserve the right to modify, revise or otherwise update these T&Cs at any time. Please ensure that you review the T&Cs regularly, including each time that you use the LME Account to take notice of any changes we have made to them, as they will be binding on you.

1. LME Account registration

1.1. Access to some areas of the LMG Sites is restricted and limited to holders of an LME Account. You will therefore be required to register for an LME Account to access that content. In addition, an LME Account may be required in order to apply to enter our events and/or LMEL competitions from time to time.

1.2. In order to register for an LME Account, you will need to provide us with certain information (which must be true, accurate and complete at all times), which will be governed by our Privacy Policy.

1.3. Some parts of the LME Account may allow you to sign-in to them through a third-party service provider (for example, Meta platforms, LinkedIn and Google). Such modes of access will be governed by the terms and conditions between you and that third party. You should read and agree to such terms and conditions before signing in to your LME Account this way.

1.4. By registering for an LME Account, you acknowledge and warrant that: you meet all other eligibility requirement(s) to access it (including any minimum age requirements from time to time); (ii) the information used during registration is accurate and not misleading; and (iii) you are prohibited from having, and you shall not take any steps in creating, more than one account for any given LME Account at any given time;.

1.5. If at any time We have reasonable grounds to believe that you have provided any information that is false or misleading, or that you have otherwise not complied with these T&Cs, We reserve the right to temporarily or permanently deactivate or delete your account and/or to immediately withdraw your right to use the LME Account for which an account is required.

2. LME Account security

2.1. You, as account holder, are fully responsible for protecting the confidentiality of your LME Account details (including your password), as well as all activities relating to your LME Account. If you choose to access your LME Account on a public or shared device: (i) make sure to sign out when you are finished accessing and using it; and (ii) do not save your login details on that device.

2.2. You shall tell us immediately if you become aware of any unauthorised use (or possible unauthorised use) of your login details or any other related unauthorised activities in connection with your account. You acknowledge that LME shall not be liable for any loss or damage arising from your failure to comply with these obligations.

3. Permitted use of your LME Account

3.1. You may use your LME Account for lawful purposes only.

3.2. You agree and acknowledge that you must not:

3.2.1. use your LME Account in any way which is:

(a) in breach of any applicable local, national or international law or regulation;

(b) unlawful or fraudulent in any way, or has any unlawful or fraudulent purpose or effect;

(c) harmful or potential harmful to minors in any way;

(d) to send, knowingly receive, upload, download, use or re-use any material which does not comply with Section 8 below; or

(e) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);

3.2.2. reproduce, duplicate, copy or re-sell any part of an LME Account in contravention of these T&Cs.

3.2.3. attempt to gain unauthorised access to any part of an LME Account, the server on which an LME Account is stored or any server, equipment or network connected to any LME Account.

3.2.4. access without authority, interfere with, damage or disrupt any software used in the provision of an LME Account or any equipment, network or software owned or used by any third party in connection with an LME Account.

3.2.5. make use of any technological, automated or manual processes in order to circumvent or manipulate the intended functionality of the LME Account, including to gain an unfair and/or unauthorised advantage accessing or applying in any event ballots.

3.2.6. misuse, damage or disrupt any LME Account by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful, or otherwise commit any criminal offences under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use and otherwise access the LME Account will immediately terminate.

4. Intellectual property rights

4.1. Excluding any User Content (as defined in Section 7.1 below) appearing within an LME Account, LME is the owner or licensee of all intellectual property rights in the LME Accounts and the material published on them. All such rights are reserved.

4.2. You must not use any part or parts of any content taken from an LME Account for commercial purposes without LME's prior written consent.

4.3. Printed or downloaded extracts of any page(s) from the LME Account shall only be used: (i) by you for personal, non-commercial purposes; or (ii) in any ways which are not otherwise in breach of any other applicable terms and conditions relating to the LMG Sites (for example, the Terms of Use or the General Conditions of Entry).

4.4. The materials printed pursuant to Section 4.3 must not be modified, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text in such materials.

4.5. If you are in breach of this Section 4,  your right to use the LME Account will cease immediately and you must, at LME’s option, return or destroy any such copies of the materials you have made.

4.6. LME’s status (and that of any identified contributors) as the author of content within an LME Account must always be acknowledged.

5. LME Marks

5.1. LME and members of LME’s group (which means LME’s subsidiaries, LME’s ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006) own a number of trade marks in numerous territories, including but not limited to the word mark 'LONDON MARATHON' and the London Marathon Events logo (collectively, the LME Marks). Other than as may be permitted by Section 6 below, you agree that you shall not use or display any LME Marks in any manner without first obtaining the prior written authorisation of LME.

6. Linking to an LME Account

6.1. A link to an LME Account:  

6.1.1. is permitted if that link accurately reflects the page of the LME Account to which you are linking.  

6.1.2. must not be in any way unfair, misleading, defamatory or otherwise damaging (or potentially damaging) to the reputation of, or taking advantage of, the good name and goodwill of LME, the LME group or their events; and

6.1.3. is not permitted if that link suggests any form of association, approval or endorsement on the part of LME, the LME group or their events, where one does not exist.

6.2. LME reserves the right to withdraw linking permissions for any reason and without notice.

7. User content

7.1. Whenever you make use of a feature that allows you to upload content and/or material to an LME Account (User Content), which may include making contact with other users of an LME Account, you must comply with Our Content Standards (as set out in Section 8 below).

7.2. You warrant that any such User Content shall comply with Our Content Standards, and you will be liable to LME and indemnify LME for any third-party claims, loss or damage arising from any breach of that warranty. If you are a consumer, this means you will be responsible for any loss or damage LME suffers as a result of your breach of warranty.

7.3. Any User Content will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you hereby grant to LME a perpetual, worldwide, non-exclusive, irrevocable, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform such User Content for any purpose across all media whether now known or hereinafter invented and you warrant that you have all applicable licences and/or permissions required for Us to use your User Content accordingly.

7.4. LME also has the right to disclose your identity to any third party who is claiming that any User Content posted or uploaded by you to an LME Account constitutes a violation of their intellectual property rights, or of their right to privacy.

7.5. To the maximum extent permitted under applicable law, LME accepts no responsibility, or liability to any third party, for the content or accuracy of any User Content posted by you or any other user of an LME Account. Please refer to Section 22 of our Terms of Use.

7.6. LME has the right to immediately remove any posting you make on an LME Account if, in LME’s sole opinion, your post does not comply with Our Content Standards.

7.7. The views expressed by other users on an LME Account do not represent LME’s views or values.

8. Content Standards

In using your LME Account, you must comply with the spirit and the letter of our Content Standards as set out at Section 7 of our Terms of Use.  

9. Non-compliance with these T&Cs

9.1. Failure to comply at any time with these T&Cs may result in LME taking all or any of the following actions at Our discretion:

9.1.1. Issuance of a warning to you;

9.1.2. Immediate, temporary or permanent withdrawal of your right to use the LME Accounts;

9.1.3. Immediate, temporary or permanent deactivation or deletion of any account you have on an LME Account;

9.1.4. Immediate, temporary or permanent removal of any User Content uploaded by you to the LME Accounts;

9.1.5. Legal proceedings being issued against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from your breach of these T&Cs;

9.1.6. Further legal action against you;

9.1.7. Disclosure of such information to law enforcement authorities as LME reasonably feels is necessary; and/or

9.1.8. Such other actions as may be set out in these T&Cs and/or as LME deems reasonably appropriate.

9.2. Any action taken by LME relating to your ability to access the LME Accounts or an account you have on an LME Account as set out above shall not affect any legal or contractual rights and obligations which may apply to you resulting from you having purchased tickets or any goods or services from Us via an LME Account. The terms and conditions applicable to your purchase of such tickets, goods or services shall continue to apply (which, for the avoidance of doubt, may include compliance with these T&Cs).

10. Applicable law

10.1. These T&Cs and the subject matter and formation of these T&Cs are governed by English law. All disputes in connection with these T&Cs shall be resolved by the courts of England and Wales. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

10.2 We reserve the right to take legal action in any jurisdiction in order to protect and enforce Our intellectual property rights.
